ktbli is not liable for any user-generated content or for any liability, damages, or expenses arising from the use of, posting of, or appearance of user-generated content on the Platform.

ktbli reserves the right to monitor and remove any user-generated content that is considered inappropriate, offensive, violates these Terms, or infringes on the rights of others.

If users post content, include these warranties: By posting content, you warrant that:

The content does not infringe on any intellectual property rights (copyright, patent, trademark) of any third party.

5. AI-Generated Content

Ownership: You understand that the Platform uses artificial intelligence to generate content. The specific ownership rights to AI-generated content may vary depending on the nature of the content and your subscription plan (if applicable). Clarify this clearly. For example:

Option A (User Ownership): "You retain ownership of the content generated by the Platform based on your inputs, subject to the limitations outlined in these Terms."

Option B (ktbli Ownership): "ktbli retains ownership of the AI-generated content. You are granted a [specific license type, e.g., non-exclusive, worldwide, perpetual] license to use the content for [permitted uses, e.g., personal and commercial purposes, excluding resale]."

Option C (Mixed Ownership): "You own the copyright in your original inputs to the Platform. ktbli owns the copyright in the specific output generated by the AI, but grants you a [license type] to use that output for [permitted uses]."

Limitations: You acknowledge that AI-generated content may not be unique and that other users may generate similar or identical content. ktbli is not responsible for any similarities between content generated by different users.

Accuracy and Suitability: ktbli does not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose. You are solely responsible for reviewing and verifying the content before using it.

Prohibited Uses: You must not use the Platform or AI-generated content:

To create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

To impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

Internet portals.

Accounting, law, and consulting firms.

Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Platform.

Any content generated using AI, even if advised that it is not fit for a specific purpose.

This limitation of liability applies regardless of the legal theory under which liability is asserted (contract, tort, breach of statutory duty, etc.).

13. Governing Law

These terms and condition are subject to the Netherlands Law.

14. Contact Us

If you have any questions about these Terms, please contact us. (Provide contact information, e.g., an email address).

Important Considerations and Next Steps:

Privacy Policy: You must have a separate, comprehensive Privacy Policy that details how you collect, use, store, and protect user data. Link to it from these Terms.

Subscription Plans (if applicable): If you have different subscription levels, clearly define the features, limitations, and content ownership rights associated with each plan. Integrate this information into the relevant sections (e.g., License, AI-Generated Content).

Specific Use Cases: Consider the specific ways users will interact with your platform and tailor the Terms accordingly. For example, if you offer an API, you'll need API-specific terms.

Jurisdiction: Specify the governing law and jurisdiction for any legal disputes.

Updates: Include a clause stating that you can update these Terms and how users will be notified (e.g., by email, by posting a notice on the Platform). Users should be bound by the updated Terms upon continued use.

Legal Review: This revised document is a starting point. It is essential to have these Terms reviewed by an attorney familiar with technology and AI law in your jurisdiction to ensure they are legally sound and enforceable. This is crucial for protecting your business.

Acceptance method: describe method of acceptance of this terme and condition, by a box or another method.

This revised version is significantly improved and tailored to ktbli. However, the legal review is absolutely critical.
